By accessing or using our website and placing an order, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use our website or services.
1. Acceptance of Terms
By using the PlayingCards.co.nz website, you signify your acceptance of these Terms and Conditions and our Privacy Policy. This includes your agreement to all clauses related to custom printing, production tolerances, and liability limitations.
2. Services Offered
PlayingCards.co.nz (“we,” “us,” or “our”) provides custom playing card printing services, including design assistance, printing, and delivery of finished products. All services are subject to these Terms.
3. User Accounts
You may be required to register an account to access certain features or place orders.
You are responsible for maintaining the confidentiality of your account details (username and password) and for all activities that occur under your account.
You agree to notify us immediately of any unauthorised use of your account.
We reserve the right to refuse service, terminate accounts, or cancel orders at our sole discretion.
4. Product Descriptions and Pricing
We strive to ensure that all product descriptions, images, and prices displayed on our website are accurate. However, errors may occur.
Prices are subject to change without notice. All prices are in New Zealand Dollars (NZD) and include GST unless otherwise stated.
While we endeavour to display colors accurately, the actual colors you see will depend on your monitor, and we cannot guarantee that your monitor’s display of any color will accurately reflect the color of the product on delivery.
5. Orders and Proof Approval
5.1 Placing an Order
All orders placed through our website are subject to availability and our acceptance. An order confirmation email does not signify our acceptance of your order; it merely confirms that we have received it. We reserve the right to decline an order for any reason, including but not limited to, availability, errors in pricing or product descriptions, or issues with your provided artwork.
5.2 Customer Responsibility for Proof Approval
Customer is solely responsible for final proof approval. This includes, but is not limited to, artwork, text, layout, image resolution, and color accuracy (including specific colour codes, e.g., CMYK, Pantone). We will provide digital proofs for your review and approval prior to production. Any errors or discrepancies (including misspellings, incorrect artwork, or layout issues) not identified by the customer during the proofing process and subsequently printed will be the sole responsibility of the customer. Alterations requested after proof approval may incur additional charges and and delay production.
5.3 Artwork Submission
You agree that any artwork or designs submitted by you for printing:
Are your own original work or that you have the necessary licenses, rights, and permissions to use and reproduce them.
Do not infringe upon the intellectual property rights or any other rights of any third party.
Are not unlawful, defamatory, obscene, or offensive. We reserve the right to refuse to print any content that we deem inappropriate or illegal.
6. Payment
Payment for all products and services must be made in full at the time of order placement unless otherwise agreed in writing.
We accept various payment methods as indicated on our website.
Your order will not be processed until payment has been successfully received.
7. Shipping and Delivery
Shipping costs are calculated at checkout and are dependent on the size, weight, and destination of your order.
Delivery times are estimates only and begin from the date of final proof approval and payment receipt, not from the date the order was placed.
We are not responsible for delays caused by third-party shipping carriers or events beyond our control.
Risk of loss and title for items purchased pass to you upon our delivery to the carrier.
8. Printing Standards and Tolerances
8.1 Industry Standards
Due to the inherent nature of the printing and cutting processes, minor variations in color, registration (alignment), and cutting may occur. We adhere to generally accepted industry-standard tolerances for these variations. While we strive for the highest quality, slight discrepancies (e.g., shifts of up to 1-2mm in cutting/trim, or minor color variations within 5-10% or the equivalent industry standard) are considered acceptable and within industry norms. Products falling within these tolerances will not be eligible for reprinting or refunds based on these minor variations.
8.2 Color Accuracy
We cannot guarantee 100% color matching between digital proofs (which are viewed on backlit monitors and vary by device calibration) and the final printed product. Colors may vary slightly due to differences in monitor calibration, file conversion, ink absorption on different paper stocks, and variations in the printing process. If exact color matching is critical, we strongly recommend ordering a physical press proof, which will incur additional costs and may extend the production timeline.
9. Claims, Returns, and Refunds
9.1 Reporting Issues
Any claims regarding print defects (beyond standard tolerances), quantity discrepancies, or quality issues must be submitted in writing via email to order@playingcards.co.nz within 10 business days of receipt of your order. To enable us to assess a claim, the customer must provide detailed documentation, including clear photographs of the alleged defects, a description of the issue, and, in some cases, return a sample of the product for our inspection.
9.2 Resolution
Products found to be materially defective due to our error (i.e., not within standard tolerances or due to customer proofing errors) will be reprinted or refunded at our sole discretion.
Reprint: If a reprint is issued, the original defective product must be returned to us for inspection (at our cost if the defect is our fault) before the reprint is processed and shipped.
Refund: If a refund is issued, the original defective product must first be returned to us for inspection (at our cost if the defect is our fault). The refund will be for the cost of the affected products only, and shipping costs are non-refundable. We are not responsible for claims made outside the specified timeframe or for issues arising from customer-approved proofs.
9.3 Custom Products
Due to the custom nature of our products, we do not offer refunds or exchanges for reasons other than material defects caused by our error, or if the product does not substantially match the approved proof (subject to standard tolerances). Orders cannot be cancelled or refunded once production has begun.
10. Expedited Orders
While we strive to meet all deadlines, expedited orders are subject to the same quality control processes as standard orders. However, due to compressed timelines, the customer acknowledges a potentially higher risk of minor imperfections or unforeseen delays. Our liability for issues arising directly from the expedited nature of such orders is limited to the cost of the expedited printing services rendered. We cannot guarantee specific delivery dates for expedited orders.
11. Intellectual Property
All content on the PlayingCards.co.nz website, including text, graphics, logos, images, software, and the compilation thereof, is our property or the property of our content suppliers and is protected by New Zealand and international copyright laws. You may not reproduce, distribute, modify, or create derivative works of any content without our prior written consent.
12. Limitation of Liability and Disclaimers
12.1 General Disclaimers
The website and all products and services are provided on an “as is” and “as available” basis. We make no representations or warranties of any kind, express or implied, as to the operation of the website or the information, content, materials, or products included on this website. You expressly agree that your use of this website is at your sole risk.
12.2 Limitation of Liability
To the fullest extent permitted by law, PlayingCards.co.nz, its directors, employees, and agents shall not be liable for any direct, indirect, incidental, special, punitive, or consequential damages whatsoever, including but not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses resulting from:
The use or inability to use the website or our services;
The cost of procurement of substitute goods and services;
Unauthorised access to or alteration of your transmissions or data;
Any other matter relating to the website or services.
12.3 Consequential Damages (Specific to Products)
Under no circumstances shall PlayingCards.co.nz be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to, loss of profits, loss of business opportunity, damages related to launch events, marketing campaigns, promotional activities, or travel expenses, even if advised of the possibility of such damages, arising from any alleged defect, delay, non-delivery, or non-suitability of the printed product. Your sole and exclusive remedy for any breach of these Terms, or any defect in our products, shall be limited to the cost of the printing services rendered for the specific product in question.
13. Indemnification
You agree to indemnify, defend, and hold harmless PlayingCards.co.nz, its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising from your violation of these Terms, your use of our services, or your infringement of any intellectual property or other right of any person or entity.

In the event of a dispute arising out of or in connection with these Terms, the parties agree to first attempt to resolve the dispute through good faith negotiation. If the dispute cannot be resolved through negotiation, the parties agree to consider mediation before resorting to litigation.

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our website and services after those revisions become effective, you agree to be bound by the revised terms.
